At Savorshots Photography, we take copyright and image usage seriously to protect our work and ensure clarity with our clients. This policy outlines the ownership of images, licensing agreements, permitted usage, unauthorized use, and photographer’s rights.
By booking our services, you acknowledge and agree to these terms.
1. Ownership of Images
- Savorshots Photography retains full copyright ownership of all images and videos created, unless a copyright buyout agreement is signed.
- Under U.S. copyright law, copyright is automatically granted to the photographer, meaning clients receive a license to use the images but do not own them.
- Clients cannot claim ownership, resell, or distribute the images without an appropriate licensing agreement.
- Unless otherwise agreed upon in writing, we reserve the right to use any captured images for our portfolio, marketing materials, website, and social media.
2. Licensing Agreements & Usage Rights
When you book a project, you are purchasing a license to use the images, not the copyright itself. Licensing terms vary based on project scope and intended usage.
2.1 Standard Commercial License (Included in Most Packages)
✔ Permitted Uses:
- Websites, social media, and digital marketing (organic posts & ads).
- Menus, brochures, and in-store displays.
- Online advertising (Google Ads, Facebook Ads, Instagram Ads, etc.).
✖ Restricted Uses:
- Reselling or sublicensing images to third parties (e.g., stock photo sites, vendors, or affiliates).
- Using images for large-scale advertising (billboards, print publications) without an extended license.
Altering images beyond basic cropping without permission.
2.2 Extended Licensing (Available for Purchase)
For brands that require wider distribution, extended licensing options can be arranged for:
- Product packaging & labels.
- Magazine, newspaper, and billboard ads.
- Use by multiple companies, vendors, or affiliates.
- Exclusive use (preventing Savorshots Photography from using the images in our portfolio).
Extended licensing is subject to additional fees based on distribution size, duration, and exclusivity.
3. Copyright Violations & Unauthorized Use
Unauthorized use of Savorshots Photography images is considered copyright infringement and may result in legal action.
3.1 Prohibited Actions
- Selling, transferring, or sublicensing images without permission.
- Editing or altering images in a way that misrepresents the original work.
- Using images for third-party endorsements without additional licensing.
- Using images outside the agreed-upon scope of work.
3.2 Enforcement & Legal Consequences
- Unauthorized usage will result in retroactive licensing fees or legal action.
- Copyright infringement penalties can include fines, takedown requests, and lawsuits.
- Clients found in violation may be banned from future services.
4. Client Requests: Additional Licensing & Copyright Buyout
4.1 Additional Licensing Requests
If a client needs to expand image usage beyond the original agreement, they must request an updated licensing agreement. Fees depend on usage type, scope, and exclusivity.
4.2 Copyright Buyout (Full Ownership Transfer)
A copyright buyout allows the client to obtain full ownership of the images, meaning Savorshots Photography no longer holds rights to use, sell, or distribute them.
✔ Benefits of a Copyright Buyout:
- Client has exclusive control over images.
- Savorshots Photography waives all portfolio and marketing rights.
- No future licensing fees or renewal costs.
💰 Buyout fees are significantly higher than standard licensing since we relinquish all future rights to the images.
5. Photographer’s Rights & Portfolio Usage
5.1 Portfolio & Marketing Use
Unless otherwise specified, Savorshots Photography reserves the right to use images for:
- Portfolio display (website, social media, marketing materials, and promotional campaigns).
- Behind-the-scenes and case studies showcasing our work process.
If a client requires exclusivity, a non-disclosure agreement (NDA) must be signed before the project begins. Additional fees may apply for full exclusivity.
5.2 Behind-the-Scenes & Promotional Content
- We may capture behind-the-scenes content (photos/videos) for promotional use.
- If a client does not want their project showcased, they must notify us before the shoot.
6. Payment Terms & Image Delivery
6.1 Payment Requirements
- A 50% non-refundable deposit is required to confirm all bookings.
- The remaining balance is due before final images are delivered.
6.2 Image Delivery & File Format
- Standard delivery is 7-14 business days unless otherwise agreed upon.
- Images are delivered in high-resolution JPEG unless specified.
- RAW files are not provided unless an additional fee is paid.
7. Agreement & Acknowledgment
By hiring Savorshots Photography, you acknowledge and agree to the Copyright & Usage Rights outlined above. These policies protect both our work and your investment.
